This English version of the Terms of Use is provided for convenience only, to make the document easier to read for non-French speakers. Only the French version is legally binding.
Each of the terms below shall have the following meaning in these Terms of Use:
These ToU set out the contractual conditions applicable to the use of the Service by a User. The conditions applicable to paid offers are covered by a separate document, the Terms of Sale (CGV), available from the Service.
Use of the Service constitutes full and unconditional acceptance of the ToU in force. We invite the User to read the ToU carefully before using the Service.
These ToU are applicable as of 2 July 2026. Gingko Lab reserves the right to modify all or part of the ToU at any time. Users are invited to review the ToU regularly to be aware of any changes.
Access to the Service is free of charge. The Website is available at the following address: https://hector.gingkolab.com. Some features are reserved for Registered Users.
The Application can be downloaded free of charge from the App Store. Some features of the Application are reserved for Users who have subscribed to a paid offer, under the conditions described in the Terms of Sale.
Gingko Lab strives to keep the Service available at all times but does not guarantee uninterrupted availability. Access may be suspended, in particular for maintenance or updates, or in case of force majeure.
The User may create a user account in order to access additional features. They may modify or delete their account at any time from the Service.
Creating an account is reserved for persons aged at least 15. A minor User declares that they have obtained the prior authorization of their legal representative. When creating an account, the User undertakes to provide accurate information and to keep it up to date.
The account is strictly personal. The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account. They undertake not to assign, sell, share or transfer their account to a third party, and to inform Gingko Lab without delay of any unauthorized use of it.
The Website allows Users to search for a phone number and view the associated information, in particular: the Verdict and its reliability index, the Reports and Comments published by Registered Users, activity and consultation statistics, and information derived from public data (such as the number's assignment and category).
The Verdict is an indicator produced automatically from declarative, statistical and public data. It is a decision aid and a mere presumption, not a verified statement about the nature of a number or the identity of its holder. It is for the User to exercise judgment in the use they make of this information.
Any Registered User may submit a Report about a call they received from a phone number. This report contains information relating to the call they received and is used to compute the Verdict.
When submitting a Report, the Registered User may add an optional message providing information useful to other Users. These Comments are displayed publicly on the Website without prior moderation, together with their author's username.
The Application allows, in particular, incoming calls to be filtered if they have an unfavorable Verdict. This feature is reserved for Registered Users who have subscribed to a paid offer described in the Terms of Sale.
To determine whether an incoming call should be blocked, the Application queries a secured API using PIR (Private Information Retrieval) technology. This technology allows the Application to obtain an answer without Gingko Lab being able to learn which phone number is being looked up.
The User may disable call filtering at any time from their iPhone settings. Deleting the Application also disables filtering.
The Website may display advertising space, including advertisements provided by third-party ad networks. Gingko Lab cannot be held responsible for the content of advertisements from third-party advertisers, nor for the websites or services they link to.
The User undertakes to use the Service in compliance with applicable laws and regulations as well as these ToU.

The User undertakes to comply with the following restrictions:
Registered Users are solely responsible for the Reports and Comments they publish. They warrant that these are based on their genuine experience and do not infringe the rights of third parties.
By publishing a Comment, the Registered User grants Gingko Lab, free of charge and worldwide, a non-exclusive license to reproduce, display and adapt this content, for the purposes of operating, promoting and improving the Service, for the entire duration of the content's publication.
Gingko Lab acts as a host of user-generated content within the meaning of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN). Gingko Lab reserves the right to remove, without notice or compensation, any content reported to it as manifestly unlawful or in breach of these ToU.
Any person who considers that content published on the Website is unlawful, does not comply with the ToU, or infringes their rights may notify Gingko Lab at contact@gingko-lab.com, specifying: their identity, the description and location of the disputed content, and the legal and factual grounds justifying the removal request. Gingko Lab will review the request as soon as possible.
Complaints from the holder of a phone number displayed on the Website are handled under the conditions set out in the article "Complaints from number holders".
Any complaint relating to the information published about a phone number must be sent to Gingko Lab at contact@gingko-lab.com, together with evidence establishing that the complainant is the holder of the number concerned. The outcome of the complaint depends on the nature of the holder.
A natural person holding a number benefits from the rights provided by Regulation (EU) 2016/679 (GDPR), and may in particular request:
The following complaints are also legitimate: the disclosure of personal data in a Comment (name, address or any identifying information), defamatory or insulting content, or the spoofing of the number by third parties established by supporting evidence.
In accordance with article 21(1) GDPR, Gingko Lab may nevertheless keep all or part of the published information if it demonstrates compelling legitimate grounds overriding the interests, rights and freedoms of the holder, in particular where the volume and consistency of the Reports establish a legitimate interest of the public in being informed of the observed use of the number.
In accordance with recital 14 of the GDPR, legal persons do not benefit from the rights of access, rectification, erasure or objection provided by that regulation. A complaint from a legal person is therefore only admissible if it concerns:
Reports, Comments and Verdicts reflecting the genuine experience and opinions of Users (for example telemarketing practices that actually occurred) do not, in themselves, constitute unlawful content and do not justify removal.
Gingko Lab responds to any complaint within a reasonable time and keeps a record of the outcome. Where number spoofing is established, Gingko Lab may display an appropriate notice on the number's page instead of removing it.
The Service, its structure, texts, graphic elements, logos and software are protected by intellectual property law and are the exclusive property of Gingko Lab or its licensors. Any reproduction or representation, in whole or in part, without the prior written authorization of Gingko Lab is prohibited.
The names "Hector" and "Gingko Lab", as well as the associated trademarks and logos, are the property of Gingko Lab. Any use without prior written authorization is prohibited. It is also prohibited to reproduce the Website within a frame (framing), to embed it into another website or service, or to present the Service as originating from a third party.
The databases built by Gingko Lab as part of the Service benefit from the database producer's protection provided for in article L341-1 of the French Intellectual Property Code. Any substantial extraction or reuse of their content (article L342-1), and any repeated and systematic extraction or reuse of non-substantial parts that manifestly exceeds the conditions of normal use of the database (article L342-2), are prohibited. Such infringements expose their author to the criminal penalties provided for in article L343-1 of the same code.
Gingko Lab expressly reserves, within the meaning of articles L122-5-3 and L342-3-1 of the French Intellectual Property Code, all rights relating to text and data mining of the Service's content and databases, in particular for the purposes of training artificial intelligence systems. No mining exception may be invoked without the prior written authorization of Gingko Lab.
The processing of Users' personal data is described in the Privacy Policy, available on the Website. The phone numbers searchable on the Service are processed under the conditions detailed therein.
The information provided by the Service, in particular Verdicts and reliability indexes, is provided for information purposes only, without any guarantee of accuracy, completeness or timeliness. It is based in particular on User statements that Gingko Lab is not in a position to verify individually.
The decision to answer a call, block it or call a number back is the sole responsibility of the User. Gingko Lab cannot be held responsible for the direct or indirect consequences of the use of the information provided by the Service, including a legitimate call that was missed or blocked.
Gingko Lab cannot be held responsible for a misunderstanding or misuse of the features by the User, nor for a failure of the features caused by third-party companies (in particular Apple and advertising networks) or by force majeure.
In the event of a breach of these ToU by a User, Gingko Lab reserves the right to remove the content concerned and to suspend or delete the User's account, without notice or compensation, without prejudice to any claim for damages.
If any part of the ToU is found to be illegal, invalid or unenforceable for any reason, the provisions in question shall be deemed unwritten, without affecting the validity of the remaining provisions, which shall continue to apply.

These ToU are governed by French law. In the event of a dispute relating to the formation, performance and/or interpretation of the ToU, exclusive jurisdiction is expressly granted to the competent courts of Bordeaux, France, failing amicable resolution of the dispute.
